{"id":1140,"date":"2014-05-09T08:24:40","date_gmt":"2014-05-09T05:24:40","guid":{"rendered":"https:\/\/ekka.edu.ee\/?page_id=1140"},"modified":"2025-12-22T14:51:25","modified_gmt":"2025-12-22T12:51:25","slug":"the-right-to-organise-studies","status":"publish","type":"page","link":"https:\/\/haka.ee\/en\/the-right-to-organise-studies\/","title":{"rendered":"The right to organise studies\u00a0in the existing\u00a0and new\u00a0higher education institutions\u00a0"},"content":{"rendered":"\n<p><strong>Higher education institutions&nbsp;(HEI)&nbsp;in Estonia can&nbsp;conduct studies only if they have been granted&nbsp;the right to organise studies in the&nbsp;respective study programme group and&nbsp;level of studies.&nbsp;<\/strong>The right to organise studies is granted&nbsp;to the institution by the level of studies, meaning separately for&nbsp;bachelor\u2019s studies, master\u2019s studies, doctoral studies, and professional higher education&nbsp;studies.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>For example,&nbsp;an institution&nbsp;has to&nbsp;apply&nbsp;for and will obtain the right&nbsp;separately in the study programme group of&nbsp;Psychology&nbsp;at the level of bachelor\u2019s studies, and study programme group of Psychology at the level of master\u2019s studies.&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p>Professional HEIs&nbsp;have to&nbsp;apply for the right&nbsp;for&nbsp;every master\u2019s programme&nbsp;separately, and the right is granted&nbsp;to the extent of that programme, not to the study programme group it belongs to.&nbsp;Once&nbsp;a&nbsp;HEI has the right to organise studies in the respective study programme group and level of studies, it may open&nbsp;other programmes&nbsp;within that study programme group without any&nbsp;external evaluation.&nbsp;New programmes&nbsp;has&nbsp;to be registered&nbsp;in&nbsp;the&nbsp;<a href=\"https:\/\/www.ehis.ee\/\" target=\"_blank\" rel=\"noreferrer noopener\">Estonian Education Information System<\/a>&nbsp;(EHIS).&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>If an institution wants to start organising studies in a study programme group in which it does not yet have&nbsp;such&nbsp;right,&nbsp;<\/strong>the institution&nbsp;has to&nbsp;submit&nbsp;an application&nbsp;together with the necessary documents to the Ministry of Education and Research (hereinafter&nbsp;the&nbsp;Ministry).&nbsp;The Ministry will involve HAKA&nbsp;in&nbsp;conducting&nbsp;an<strong>&nbsp;initial&nbsp;assessment of the study programme group<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Based on the results of the&nbsp;initial&nbsp;assessment, the institution&nbsp;may be granted&nbsp;the right either for unspecified term&nbsp;<em>(in which case there will not be a re-assessment)<\/em><strong>&nbsp;<\/strong>or&nbsp;specified term&nbsp;<em>(the right for&nbsp;1-3&nbsp;years).<\/em>&nbsp;In case of&nbsp;specified term, HAKA will conduct a&nbsp;<strong>re-assessment of the study programme group<\/strong>&nbsp;if the&nbsp;institution&nbsp;submits&nbsp;an application to the Ministry of&nbsp;Education and Research.&nbsp;&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-pb-accordion-item c-accordion__item js-accordion-item no-js\" data-initially-open=\"false\" data-click-to-close=\"true\" data-auto-close=\"false\" data-scroll=\"false\" data-scroll-offset=\"0\"><h2 id=\"at-11400\" class=\"c-accordion__title js-accordion-controller\" role=\"button\"><strong>What is being assessed&nbsp;when applying for the right to organise studies?&nbsp;<\/strong><\/h2><div id=\"ac-11400\" class=\"c-accordion__content\">\n<p><strong>When applying for the right \u2013 both in case of&nbsp;initial&nbsp;and re-assessment of a study programme group \u2013 it will be assessed whether&nbsp;the quality of studies meets the requirements laid down for the relevant&nbsp;level&nbsp;of higher education, and whether resources and sustainability are adequate for the provision of&nbsp;studies.&nbsp;<\/strong>Assessment is conducted in\u202fsix assessment areas; in case of a new HEI&nbsp;additional&nbsp;criteria will be included:&nbsp;<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>Study programme;&nbsp;<\/li>\n\n\n\n<li>Learning and teaching, <\/li>\n\n\n\n<li>Organisation of studies, <\/li>\n\n\n\n<li>Academic staff, <\/li>\n\n\n\n<li>Learning and teaching environment, <\/li>\n\n\n\n<li>Financial&nbsp;resources, <\/li>\n\n\n\n<li>Additional&nbsp;criteria for a new higher education institution.&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>HAKA&nbsp;will&nbsp;form an expert panel for conducting the assessment. If foreign experts are included in the panel,&nbsp;HAKA will inform the HEI about the need to&nbsp;submit&nbsp;the application documents in English.\u202fBased on the analyses, the expert panel will&nbsp;determine&nbsp;for each&nbsp;assessment area, whether it: 1)&nbsp;conforms to the required standard, 2)&nbsp;partially conforms to the required standard, 3)&nbsp;does not conform to the required standard.&nbsp;<\/p>\n\n\n\n<p>Based on the assessment report,&nbsp;<a href=\"https:\/\/haka.ee\/en\/quality-assessment-council\/\" target=\"_blank\" rel=\"noreferrer noopener\">HAKA Quality Assessment Council for Higher Education<\/a>&nbsp;makes a proposal to the Minister of Education and Research, whether to grant the higher education institution the right to organise studies in the relevant study programme group and level of higher education for\u202f<strong>1) unspecified term, 2) for&nbsp;1-3&nbsp;years, or 3) not to grant the right<\/strong>.&nbsp;The decision&nbsp;regarding&nbsp;the&nbsp;right&nbsp;to organise studies&nbsp;will be&nbsp;made&nbsp;by&nbsp;the minister of education and research.&nbsp;<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-pb-accordion-item c-accordion__item js-accordion-item no-js\" data-initially-open=\"false\" data-click-to-close=\"true\" data-auto-close=\"false\" data-scroll=\"false\" data-scroll-offset=\"0\"><h2 id=\"at-11401\" class=\"c-accordion__title js-accordion-controller\" role=\"button\"><strong>Documents&nbsp;to be&nbsp;submitted&nbsp;when applying for the right to organise studies&nbsp;<\/strong>&nbsp;<\/h2><div id=\"ac-11401\" class=\"c-accordion__content\">\n<p>The following legal acts regulate higher education&nbsp;provision&nbsp;in Estonia:&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Higher Education Act: <a href=\"https:\/\/www.riigiteataja.ee\/en\/eli\/522092025001\/consolide\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/www.riigiteataja.ee\/en\/eli\/522092025001\/consolide<\/a> <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Private Schools Act: <a href=\"https:\/\/www.riigiteataja.ee\/en\/eli\/ee\/501092025003\/consolide\/current\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/www.riigiteataja.ee\/en\/eli\/ee\/501092025003\/consolide\/current<\/a><\/li>\n<\/ul>\n\n\n\n<p>Initial and re-assessment of study programme groups is carried out&nbsp;in accordance with&nbsp;the&nbsp;regulation&nbsp;approved by HAKA Quality Assessment Council for Higher&nbsp;Education&nbsp;<a href=\"https:\/\/haka.ee\/wp-content\/uploads\/Guidelines-for-initial-and-reassessment_EN-2.07.24-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Guidelines for initial assessment and re-assessment in higher education.<\/strong><\/a>&nbsp;Appendix 1 to the Guidelines&nbsp;lists the information to be&nbsp;submitted&nbsp;with the application.&nbsp;<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-pb-accordion-item c-accordion__item js-accordion-item no-js\" data-initially-open=\"false\" data-click-to-close=\"true\" data-auto-close=\"false\" data-scroll=\"false\" data-scroll-offset=\"0\"><h2 id=\"at-11402\" class=\"c-accordion__title js-accordion-controller\" role=\"button\"><strong>Cost of the&nbsp;assessment<\/strong>&nbsp;<\/h2><div id=\"ac-11402\" class=\"c-accordion__content\">\n<p>The\u00a0institution\u00a0bears the cost of the assessment\u00a0of the application.\u00a0<strong>The fees\u00a0of\u00a0assessment<\/strong>\u00a0and the calculation of the expenses forming their basis are\u00a0established\u00a0in the\u00a0<a href=\"https:\/\/haka.ee\/wp-content\/uploads\/ekspertiisi-tasumaara-kehtestamine_HAKA.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">directive<\/a>\u00a0of the\u00a0Director General\u00a0of \u202fthe\u00a0Education and Youth Board. As of 18.12.2025, the base rate is 9,393\u00a0Euros.\u00a0<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-pb-accordion-item c-accordion__item js-accordion-item no-js\" data-initially-open=\"false\" data-click-to-close=\"true\" data-auto-close=\"false\" data-scroll=\"false\" data-scroll-offset=\"0\"><h2 id=\"at-11403\" class=\"c-accordion__title js-accordion-controller\" role=\"button\"><strong>The process of opening a new higher education institution<\/strong>&nbsp;<\/h2><div id=\"ac-11403\" class=\"c-accordion__content\">\n<p>For opening and operating a private higher education institution in Estonia&nbsp;(regardless of the type of HEI or form of study),&nbsp;<strong>the procedure is&nbsp;similar to what has been described above<\/strong>:&nbsp;an application&nbsp;must be submitted to the Ministry of Education and Research&nbsp;for obtaining the right to&nbsp;organise studies&nbsp;in one or more study programmes within&nbsp;the respective&nbsp;study programme group(s)&nbsp;and level of studies.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>There are no separate conditions for online higher education institutions in the Estonian legislation. The right to organise studies&nbsp;must be applied for the entire study programme group&nbsp;and level of&nbsp;studies, and the assessment&nbsp;is based on the assumption&nbsp;that the higher education institution (including&nbsp;fully online&nbsp;HEI)&nbsp;can&nbsp;also conduct studies on-site and has the&nbsp;appropriate infrastructure&nbsp;and human resources for this purpose.&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p>In order to&nbsp;open a new&nbsp;HEI and obtain the right to organises studies, the following&nbsp;steps need to be taken:&nbsp;&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">1)&nbsp;Obtaining the status of an owner of the higher education institution&nbsp;&nbsp;<\/h4>\n\n\n\n<p>First, it is necessary to&nbsp;<strong>create a legal entity<\/strong>&nbsp;(<em>Private School Act \u00a7 2<\/em>). This means that the owner of a private&nbsp;educational institution&nbsp;must be entered 1) in the commercial register as a public limited company or a private limited company, or 2) in the register of non-profit associations and foundations as a foundation or non-profit association.&nbsp;<\/p>\n\n\n\n<p>Since the existence of a legal entity is necessary to&nbsp;establish&nbsp;a private&nbsp;educational institution, it is not sufficient to open a branch of a foreign company in Estonia.&nbsp;<\/p>\n\n\n\n<p>When creating a legal entity, the&nbsp;<strong>capital requirements set for the&nbsp;owner&nbsp;must be&nbsp;taken into account&nbsp;(640,000&nbsp;Euros&nbsp;for a university, 380,000&nbsp;Euros&nbsp;for&nbsp;a professional&nbsp;higher education&nbsp;institution).&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>The registration of the&nbsp;owner&nbsp;in the commercial register takes place&nbsp;in accordance with&nbsp;the provisions of the Commercial Code.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>\u202f<\/strong>\u202f2)&nbsp;Applying for the right to organise studies&nbsp;&nbsp;<\/h4>\n\n\n\n<p>The&nbsp;owner&nbsp;submits&nbsp;an application and documents to the Ministry of Education and Research to obtain the right to conduct studies at a specific higher education level and&nbsp;study programme&nbsp;group. The Ministry of Education and Research, together with&nbsp;HAKA, organises an assessment of the application and the attached data. As a rule, foreign experts are involved in the assessment, so it is recommended to&nbsp;submit&nbsp;documents in English in addition to Estonian.&nbsp;<\/p>\n\n\n\n<p>The&nbsp;owner of the HEI&nbsp;submits to the Ministry of Education and Science at least 9 months before the start of the academic year information on the&nbsp;study programmes&nbsp;to be opened, academic staff and their qualifications, the necessary infrastructure and sources of funding for studies, justifications for the need to open studies (including information on the target group and proposals from professional and specialist associations and boards), as well as the statutes\/statutes of the private school, and the establishment agreement of the&nbsp;owner.&nbsp;<\/p>\n\n\n\n<p>The requirements for applying for the right are set out in \u00a7 9 of the Higher Education Act. According to \u00a7 9(3) of the Act, the Ministry of Education and Research involves the&nbsp;Estonian&nbsp;Quality Agency&nbsp;for Education (HAKA)&nbsp;in reviewing the application.&nbsp;<strong>A list specifying the data mentioned in \u00a7 9 of the Higher Education Act can be found in Appendix 1 of the document&nbsp;<\/strong><a href=\"https:\/\/haka.ee\/wp-content\/uploads\/Guidelines-for-initial-and-reassessment_EN-2.07.24-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Guidelines for Initial&nbsp;Assessment&nbsp;and Re-Assessment&nbsp;in Higher Education<\/strong><\/a>.&nbsp;<\/p>\n\n\n\n<p>Please note that the following information is required for all teaching staff of each subject&nbsp;of&nbsp;each&nbsp;study programme: name of the&nbsp;academic staff member, year of birth, position, workload at the higher education institution, qualification, subject(s)&nbsp;taught and&nbsp;their&nbsp;volume, link to the English CV in the Estonian Science Information System (hereinafter ETIS) or elsewhere,&nbsp;overview of teaching or research work at foreign higher education institution(s)&nbsp;in the last 5 years.&nbsp;&nbsp;<\/p>\n\n\n\n<p>It is also important to note that&nbsp;<strong>the&nbsp;heads&nbsp;of Estonian educational institutions, including&nbsp;professional HEIs, their deputies and directors of studies must have&nbsp;the Estonian language&nbsp;proficiency&nbsp;at C1 level<\/strong>.&nbsp;These&nbsp;requirements arise from Section 9, point 6, of the Government of the Republic Regulation on the Requirements for the Proficiency and Use of the Estonian Language by Officials, Employees and Self-Employed Entrepreneurs:&nbsp;<a href=\"https:\/\/www.riigiteataja.ee\/akt\/110082021011\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/www.riigiteataja.ee\/akt\/110082021011<\/a>.&nbsp;<\/p>\n\n\n\n<p>If the application meets the conditions, the Minister of Education and Research&nbsp;will&nbsp;confirm&nbsp;the right to&nbsp;organise studies,&nbsp;which means receiving an operating license.&nbsp;&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">\u202f3)&nbsp;Submitting&nbsp;data&nbsp;to&nbsp;EHIS&nbsp;<\/h4>\n\n\n\n<p>Obtaining an operating permit provides the basis for entering an educational institution into the sub-register of educational institutions, guided by the provisions of the EHIS statutes. The educational institution that has received an operating permit&nbsp;submits&nbsp;the data via the state portal eesti.ee and receives access to the register from the controller of the register.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The educational institution&nbsp;submits&nbsp;data on&nbsp;the study programmes&nbsp;to EHIS&nbsp;in accordance with&nbsp;the provisions of the EHIS statutes, and the Ministry of Education and Culture assesses the compliance of the&nbsp;programmes.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">\u202f4)&nbsp;Declaring an educational institution as established&nbsp;<\/h4>\n\n\n\n<p>A private&nbsp;educational institution&nbsp;is considered&nbsp;established&nbsp;from the date the first&nbsp;study programme&nbsp;of the&nbsp;institution&nbsp;is entered into EHIS.&nbsp;<\/p>\n\n\n\n<p>A private higher education institution can be either a university or a&nbsp;professional&nbsp;higher education&nbsp;institution.
